Singapore High Court Orders Details of Illegal Downloaders to be Dilvulged
In a recent copyright infringement case in Singapore, the High Court has ordered a local Network Service Provider (NSP) to furnish Japanese Anime copyright owners with the Internet Protocol (IP) addresses of the NSP’s subscribers who had illegally downloaded Anime titles. Anime refers to a distinct type of cartoon animation originating from Japan.
The facts of the case are rather interesting. The case was filed by licensee Odex Pte. Ltd. (“Odex”), a Singapore company (and not the licensor/copyright owner). Odex is licensed to distribute various Anime titles in Singapore.
In its Statement of Claim, Odex requested that the NSP release the IP addresses of subscribers who were downloading Anime titles illegally. However, it was unsuccessful in obtaining the IP addresses as it was determined that Odex was not an exclusive licensee in Singapore.
MATRADE Grants Temporarily Suspended
Due to the very enthusiastic response for Services Export Fund Grant 4 (for Export Promotion Activities), the funds set aside have been fully utilized. Please note that MATRADE will no longer be accepting applications for Grant 4 for all eligible activities undertaken from 1 December 2009.

Regional Young Women Scientists Acquire Insights On Understanding And Protecting IP Rights
Our principal, Mr. P. Kandiah, was recently invited to give a presentation on “Understanding and Protecting Intellectual Property Rights” for the Regional Young Women Researchers Workshop.
The presentation provided an overview of what Intellectual Property (IP) is, with a detailed account of the current IP rights available to scientists/researchers in Malaysia. Emphasis was placed on patents, since they are the IP rights most crucial to scientists. There was an in-depth discussion on commercialisation of research, and the issues surrounding the publication of research were also addressed. Publication is a particularly tricky issue for scientists, who are often eager to get their findings out into the public domain, seeing that published work provides a form of recognition and contributes to the status of the scientist. However at the same time publication can negate novelty, preventing the owner from obtaining a patent. Obtaining a patent is crucial if the researcher wants to commercialise their findings, as no investors are interested in work that is readily available to the public.
Vietnam IP Updates
The Vietnam National Assembly has amended its Intellectual Property (IP) Law, with the amendments coming into force on 1 January 2010.
The amendment is part of Vietnam’s attempt to resolve the discrepancies between their current law and international IP law, and is also aimed to resolve some of the inconsistencies found within their current law.
Notable amendments include the Vietnam National Assembly’s addressing the important issue of IP rights enforcement. The assembly has elected to remove the requirement for “cease and desist” letters prior to requesting an administrative action.
