The Intellectual Property Office of Singapore (IPOS) recently decided on a trademark invalidation case. On 30 April 2003, applications to invalidate a registered “Raffles” word mark in Class 35 (for secretarial services, book keeping services and business management consultancy) and Class 36 (for financial consultancy) were filed by Raffles Fine Arts Auctioneers Pte. Ltd. (“the Applicant”) on the grounds that they owned prior rights to the unregistered marks “Raffles” and “Raffles Fine Arts” used for business consultancy and financial solutions, and that the use of the registered “Raffles” mark by the registered owners, Raffles Corporate Consultants Pte. Ltd. amounted to passing off.

What’s in a Shape and Color of a Pharmaceutical Tablet?
If a product has a novel shape and configuration, appeals to the eye, and is not dictated by a function, then the shape can be registered as an Industrial Design. Upon registration, exclusive rights are given to the owner of the design for a limited period of time. Furthermore, if the shape of a product is distinctive it can be registered as a trademark in some countries (not so in Malaysia at present).
Pfizer has registered the unique shade of blue of the Viagra® tablet as a trademark in countries where colour of a product can be registered as a trademark. It also registered the unique shape of the tablet as a trademark in many countries.
